hereinafter referred to as “MD Labels”, “Seller”, “we”, “us” or “our”.

These Terms of Service govern the use of the Store, electronic services provided through the Store and sales contracts concluded through the Store.

By placing an order, the Customer confirms that they have read these Terms and agree to be bound by them.

Nothing in these Terms limits any mandatory rights granted to Consumers under applicable law.

2. DEFINITIONS

A Customer is any natural person, legal person or organisational entity placing an order or using the Store.

A Consumer is a natural person entering into a transaction for purposes that are outside their trade, business, craft or profession.

Where Polish law grants certain consumer rights to a natural person conducting business activity who enters into a contract directly related to that activity but the contract is not of a professional nature for that person, those rights shall also apply in accordance with applicable law.

A Product means any product offered for sale through the Store.

A Custom Product means a non-prefabricated Product manufactured according to the Customer's individual specifications or clearly personalised to meet the Customer's individual needs.

3. ELECTRONIC SERVICES AND TECHNICAL REQUIREMENTS

The Store enables Customers to browse Products, use the order form, place orders, contact MD Labels and, where available, use a customer account or other functions provided through the Store.

Electronic services required to browse and place orders are provided free of charge unless expressly stated otherwise.

To use the Store correctly, the Customer should have access to the Internet, a current web browser supporting standard web technologies, and a valid e-mail address where required for placing an order.

Certain Store functions may require cookies, JavaScript or similar technical features to operate correctly. Information concerning cookies and personal data is provided in our Privacy Policy and Cookie Policy, where applicable.

Customers must not provide unlawful content, interfere with the operation or security of the Store, attempt unauthorised access, distribute malware, or use the Store in violation of applicable law.

The Customer may stop using an electronic service at any time. Where a customer account is available, the Customer may request its closure.

Complaints concerning electronic services may be submitted to sklep@mdlabels.pl. The complaint should contain sufficient information to identify the issue and enable us to respond.

4. PRODUCT INFORMATION

We make reasonable efforts to ensure that Product descriptions, specifications, dimensions, photographs, colours, quantities and other information displayed in the Store are accurate.

Colours and appearance may vary slightly depending on screen settings, materials, production batches and printing processes.

Before purchasing labels intended for a particular printer or application, the Customer should verify relevant specifications such as label dimensions, material, core diameter, printing technology and compatibility.

Warning, transport, ADR, UN, GHS or other identification labels must be selected according to the Customer's actual application and applicable regulations. The Customer is responsible for selecting the correct type of marking unless MD Labels has expressly confirmed otherwise for a specific order.

We may update Product descriptions or discontinue Products, provided that such changes do not affect sales contracts already concluded.

5. ORDERS AND CONCLUSION OF THE SALES CONTRACT

Products displayed in the Store may be ordered using the online checkout.

To place an order, the Customer selects the Product and quantity, enters the required billing and delivery details, selects an available delivery and payment method, reviews the order and submits it using the checkout button indicating an obligation to pay.

Before submitting the order, the Customer has the opportunity to identify and correct input errors.

After an order is submitted, the Customer receives an electronic confirmation at the e-mail address provided during checkout.

The sales contract is concluded when MD Labels confirms acceptance of the order for processing, unless applicable law provides otherwise.

We may refuse or cancel an order where, for example, the Product is unavailable, an obvious pricing or technical error has occurred, payment has not been successfully authorised, required information is missing, or fulfilling the order would violate applicable law.

If an order that has already been paid is not accepted, the amount paid will be refunded without undue delay.

6. PRICES, VAT AND PROMOTIONS

Prices are displayed in the currency applicable to the Customer's selected market.

For Consumers, prices include applicable taxes where required by law. Delivery charges and any other additional charges are displayed before the order is submitted.

For business Customers, VAT treatment may depend on the Customer's status, VAT registration, billing information, delivery country and applicable tax rules.

The final price payable is displayed during checkout before the Customer submits the order.

Where we announce a price reduction to Consumers, information concerning the prior price will be provided in accordance with applicable law. Where required, the reference price is the lowest price applied during the 30 days preceding the price reduction.

Discount codes and promotions may be subject to separate conditions communicated together with the relevant promotion.

7. PAYMENT

Available payment methods are displayed during checkout.

Payment must be made using one of the payment methods offered by the Store.

The Customer is responsible for providing accurate payment and billing information.

Payment services may be provided by independent payment service providers. Their own terms and privacy rules may apply to the processing of payments.

8. DELIVERY

Available delivery methods, delivery areas and applicable delivery charges are displayed in the Store or during checkout.

Orders are delivered to the address provided by the Customer.

Estimated dispatch and delivery times are informative unless expressly agreed otherwise. Delays may occur due to circumstances outside our reasonable control, including delays caused by carriers, customs authorities or exceptional events.

For Consumers, the risk of loss of or damage to the Products passes to the Consumer when the Consumer, or a third party designated by the Consumer other than the carrier, takes physical possession of the Products.

If the Consumer independently appoints a carrier that was not offered by MD Labels, the risk may pass when the Product is delivered to that carrier in accordance with applicable law.

9. RIGHT OF WITHDRAWAL

A Consumer who concludes a distance sales contract through the Store generally has the right to withdraw from the contract without giving any reason within 14 days.

For a contract for the sale of a single Product, the withdrawal period begins when the Consumer, or a third party designated by the Consumer other than the carrier, receives the Product.

Where one order contains Products delivered separately, the period begins upon receipt of the last Product, batch or part, where applicable.

To exercise the right of withdrawal, the Consumer must inform MD Labels of their decision by an unequivocal statement before the withdrawal period expires.

The statement may be sent by e-mail to:

sklep@mdlabels.pl

or in writing to:

MD Labels
ul. Chocimska 2
62-800 Kalisz
Poland

The Consumer may use the model withdrawal form included at the end of these Terms, but its use is not mandatory.

After notifying MD Labels of the withdrawal, the Consumer must return the Product without undue delay and no later than 14 days after communicating the decision to withdraw.

Unless MD Labels agrees otherwise, the Consumer bears the direct cost of returning the Product.

MD Labels will refund payments received from the Consumer, including the cost of standard delivery up to the cost of the least expensive standard delivery method offered for the order, without undue delay and no later than 14 days after being informed of the withdrawal.

We may withhold the refund until we receive the returned Product or the Consumer provides evidence that the Product has been sent back, whichever occurs first.

Refunds will normally be made using the same payment method used for the original transaction unless another method has been expressly agreed.

The Consumer may be responsible for any reduction in the value of the Product resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Product.

10. PRODUCTS EXCLUDED FROM THE RIGHT OF WITHDRAWAL

The statutory right of withdrawal does not apply where an applicable legal exception exists.

In particular, the right of withdrawal does not apply to a non-prefabricated Product manufactured according to the Consumer's specifications or clearly personalised to satisfy the Consumer's individual needs.

This may include, where offered through the Store, labels manufactured specifically according to an individual design, dimensions, print, artwork or other non-standard specification provided or approved by the Customer.

Selecting a standard size, colour, quantity or other standard variant normally available in the Store does not by itself make a Product personalised.

11. COMPLAINTS AND CONFORMITY OF PRODUCTS

MD Labels is responsible to Consumers for the conformity of Products with the sales contract in accordance with applicable law.

A Product should, among other things, correspond to its description, type, quantity and quality and be suitable for the purposes that Products of the same type are normally used for, subject to the particular characteristics communicated before purchase.

If a Product is not in conformity with the contract, the Consumer may exercise the remedies available under applicable law, including repair or replacement and, where the statutory conditions are met, a price reduction or withdrawal from the contract.

MD Labels bears the costs of bringing a Product into conformity where required by law.

Under Polish consumer law, the Seller is generally responsible for lack of conformity existing within two years from delivery of the Product.

Complaints may be submitted by e-mail to sklep@mdlabels.pl or in writing to the Seller's address.

The complaint should, where possible, contain the order number, description of the issue and the Customer's requested remedy.

A receipt is not the only acceptable proof of purchase.

MD Labels will respond to a Consumer complaint within 14 days where this deadline applies under applicable law.

Any commercial guarantee provided for a particular Product is independent from and does not limit statutory rights.

12. BUSINESS CUSTOMERS

Sections of these Terms that expressly concern Consumers apply to business Customers only where mandatory law grants them equivalent rights.

In particular, certain consumer protections under Polish law may also apply to a natural person conducting business activity where the contract is directly related to that activity but does not have a professional nature for that person.

Business Customers are responsible for providing accurate company and VAT information when placing an order.

13. CUSTOM PRODUCTS AND CUSTOMER-SUPPLIED MATERIALS

Where the Store allows Customers to order Products using their own artwork, text, logo, barcode, graphic or other content, the Customer is responsible for ensuring that they have the right to use that content.

The Customer must not submit content that is unlawful, infringes intellectual property rights, violates third-party rights or would cause MD Labels to breach applicable law.

Where MD Labels provides a proof or design for approval, production may commence after Customer approval.

The Customer is responsible for reviewing the approved content, including text, spelling, dimensions and other order specifications.

Reasonable technical differences resulting from printing, cutting, materials, screens or manufacturing processes do not constitute a defect where they remain within the agreed Product specification and applicable standards.

14. INTELLECTUAL PROPERTY

The content of the Store, including text, photographs, graphics, designs, trademarks, logos, Product content and website layout, is protected by applicable Polish, European Union and international intellectual property laws.

No content may be copied, reproduced, distributed, modified or commercially exploited without permission unless such use is expressly permitted by law.

Customer-owned artwork remains the property of the Customer or the relevant rights holder.

By supplying materials to MD Labels for the purpose of fulfilling an order, the Customer grants MD Labels the limited rights necessary to manufacture and deliver the ordered Products.

15. SHOPIFY AND THIRD-PARTY SERVICES

The Store is hosted using Shopify technology.

Sales contracts for Products purchased from the Store are concluded with MD Labels, not with Shopify.

Certain functions of the Store may be provided by third-party service providers, including payment providers, carriers or technical service providers.

Use of those services may additionally be subject to their own applicable terms.

16. PERSONAL DATA

Personal data is processed in accordance with our Privacy Policy.

Information concerning cookies and similar technologies is provided in our Cookie Policy or relevant consent settings.

Shopify and other service providers may process data to the extent necessary to operate the Store and provide their services.

Nothing in these Terms replaces or limits the information provided in the Privacy Policy.

17. PROHIBITED USE OF THE STORE

The Customer may not use the Store for unlawful or fraudulent purposes, interfere with its security or operation, attempt unauthorised access, distribute malicious software, impersonate another person, submit unlawful content or infringe intellectual property or privacy rights.

We may restrict access where reasonably necessary to protect the Store, Customers or third parties, or to comply with applicable law.

18. LIABILITY AND EVENTS OUTSIDE OUR CONTROL

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including mandatory statutory Consumer rights.

MD Labels is not responsible for a Customer's improper use of a Product or for using a Product for a purpose inconsistent with its description, specification or applicable instructions.

MD Labels is not responsible for failure or delay caused by events outside its reasonable control to the extent permitted by applicable law.

Where a Customer is a Consumer, any limitation in these Terms applies only to the extent permitted by mandatory consumer protection law.

19. OUT-OF-COURT DISPUTE RESOLUTION

Consumers may have access to out-of-court complaint and dispute resolution procedures.

In Poland, information concerning consumer rights and available out-of-court procedures can be obtained from the Polish Office of Competition and Consumer Protection (UOKiK), consumer ombudsmen and the competent Trade Inspection authorities.

The use of an out-of-court procedure is voluntary unless applicable law provides otherwise.

20. GOVERNING LAW AND JURISDICTION

These Terms and sales contracts concluded through the Store are governed by Polish law.

However, if the Customer is a Consumer residing in another country, this choice of Polish law does not deprive the Consumer of mandatory protection granted by provisions of law that would otherwise apply to the Consumer. EUR-Lex

Any dispute will be submitted to the court having jurisdiction under applicable law.

Nothing in these Terms limits a Consumer's right to bring proceedings before a court competent under mandatory consumer protection rules.

21. CHANGES TO THESE TERMS

We may update these Terms where reasonably necessary, for example because of changes in law, Store functionality, payment or delivery methods, or business operations.

Changes do not adversely alter the terms of sales contracts concluded before the updated Terms entered into force.

The version applicable to an order is the version in effect when the order was placed.

The current version is available in the Store at all times.
